Trip Preparation

While Paul Hyde Journeys trips deliver rewarding experiences to travelers they also entail risks often beyond those encountered at home. Participants must ensure that they are healthy and fit; read all pre-trip material on clothing, training and medical requirements; and to appreciate that in some cases living conditions, local practices, services and accommodation may differ significantly from that of their home country.

Payment and Reservations

To reserve a trip, we require a deposit of US$750 per person. The balance of payment is due 90 days prior to departure. To complete a reservation, Travellers must complete, sign and return a Traveler Information Form, and an Acknowledgement of Risk, Release and Indemnity no longer than 14 days after the initial deposit is paid.

There is a single supplement charge to individual travelers wishing to ensure that they have private rooms throughout a trip. Our prices are in U.S. dollars. Canada's 7% Goods and Services Tax applies on trips in Canada. (Note: approximately half of the GST is refundable to nonresidents of Canada).

Independent Travel Services

Periodically Paul Hyde Journeys may recommend the services of independent travel agencies or other support services organizations that are outside the scope of the Paul Hyde Journeys Trip. We can in no way guarantee the services provided by these third part service providers. Paul Hyde Journeys can not be held liable for any expenses, costs, errors or inconvenience arising from these services, or the lack of such services, provided by any independent third party services company.

Acknowledgement of Risk, Limitation of Liability, Release and Indemnity

To be eligible to participate in a Paul Hyde Journeys Trip, as appears on the Paul Hyde Journeys Website (paulhydejourneys.com) or in promotional materials (a "Trip") it is important that the participant (the "Traveller") recognizes the risks inherent in a Trip and understands that Paul Hyde Journeys can have no responsibility of any kind for any eventuality involving the Traveller. Where dependents are joining a Traveller on a Trip, the term "Traveller" includes such persons.

Risks

A Trip is subject to a number of risks, only some of which include the following:

Harsh Conditions

Paul Hyde Journeys are intentionally designed to take clients to destinations with the possibility of harsh weather conditions and rugged terrain where means of access, facilities, infrastructure and safety and other standards may not be sophisticated and may be different from and below the quality and levels of those of a Traveller's home country or elsewhere.

Condition of Traveller

Trips involve physical activity which is very demanding and a Traveller's existing physical and medical condition is important. Travellers and dependents travelling on the Trip should consult their physicians and obtain medical advice. By returning a completed Information Form, a Traveller is certifying that such Traveller is at an adequate fitness level to undertake the Trip, has no physical conditions or disabilities that could be dangerous to such Traveller or others on the Trip or which pose a risk of injury and that the Traveller has received all necessary vaccinations.

Injury and Loss

Trips involve the risk of loss and damage to personal property and of serious personal injury, including permanent disability or death. Rescue services and medical facilities may not be easily accessible, sophisticated or to the standards of a Traveller's home country.

Suppliers

Lodging, transportation, food and beverages, equipment, local tours and activities are provided by local suppliers for whom Paul Hyde Journeys has no responsibility or control. Demonstration equipment may be provided by such suppliers and Travellers may be required to sign an additional waiver of liability in connection with the use thereof.

Insurance

Before the Trip, Travellers should consult with their insurance brokers or carriers to ensure that they have adequate coverage for themselves and dependents and family members travelling on the Trip, including for medical care, property loss, illness, disability, financial loss, injury or death.

Representations

The Traveller, on behalf of the Traveller and all dependents travelling on the Trip, represents to and agrees with Paul Hyde Journeys (knowing that Paul Hyde Journeys is relying thereon) as follows:
  • The Traveller has considered all risks of the Trip, set out above and accepts them
  • The Traveller knows that there may be risks other than those set out above and accepts them, whether foreseeable or not
  • The Traveller has consulted with their physician and confirmed that their physical and medical condition and that of their dependents coming on the Trip is at an adequate fitness level to undertake the Trip and there are no physical conditions or disabilities that could be dangerous to the Traveller, their dependents or others on the Trip or which pose a risk of injury to the Traveller or such dependents or others
  • The Traveller has consulted with their insurer or its representative and confirmed that they have sufficient insurance coverage knowing the risks of the Trip
  • The Traveller understands that Paul Hyde Journeys must have the complete authority in its sole discretion to accept or reject any Traveller for a Trip and to determine if a Traveller's or dependent's actions during the Trip impedes the operation of the Trip, constitutes a risk to the welfare, safety or enjoyment of others or the reputation of Paul Hyde Journeys and that Paul Hyde Journeys may terminate their participation in a Trip at any time without returning any fees or other amounts paid.
  • The Traveller acknowledges that they have read all information on the Paul Hyde Journeys website and printed materials received by them and accept the conditions stated therein
Release and Indemnity

In consideration of Paul Hyde Journeys accepting the Traveller and their dependents joining on a Trip, on behalf of themselves and such dependents:

Release and Indemnity

The Traveller releases and forever discharges and indemnifies and saves harmless Paul Hyde Journeys from and against any and all costs, damages, claims, demands, suits or actions of any nature or kind arising in connection with or as a consequence of the Trip, whether monetary or non-monetary, including without limitation, damages or liability for physical injury, permanent disability or death, general damages, including for pain and suffering, emotional distress, loss of companionship or consortium, or similar loss, financial loss and/or loss of support, property or any other losses of any nature or kind, which the Traveller or any dependents may suffer or cause to third parties.

Third Party Suppliers

The Traveller acknowledges and agrees that Paul Hyde Journeys will not be liable for any act or omission of an independent supplier or unrelated third party. The Traveller further acknowledges that the services provided by such parties are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers and may be limited by their tariffs, conditions or carriage, tickets, vouchers and international conventions and agreements.

Use of Images

The Traveller agrees that Paul Hyde Journeys may use any photographic or film records of the Trips for promotional and/or commercial purpose, without any remuneration to the Traveller. The Traveller hereby assigns all right, title and interest they may have in or to any media in which their name or likeness might be used to Paul Hyde Journeys.

Cancellation by Paul Hyde Journeys

Paul Hyde Journeys reserves the right to cancel any Trip at any time for any reason if there are too few participants, or if the quality of a Trip or the safety of the Travellers is judged to be compromised. In such a case, the refund of payments received by Paul Hyde Journeys shall constitute full settlement. Paul Hyde Journeys cannot assume responsibility for any loss incurred as a result of non-refundable or non-transferrable air tickets or other expenses.

Cancellation Protection Program

We strongly recommend Journey cancellation protection. The price of Journey cancellation protection is automatically added to each reservation and will appear on your invoice. If we do not receive payment for the Journey Cancellation Protection Plan at the time of your final payment for the trip it will be assumed that you have declined these items. For reservations made within 90 days prior to departure, payment for the Journey Cancellation Protection Plan must be included with your full trip payment.

Journey cancellation protection allows travelers to cancel their Paul Hyde Journeys reservation at any time prior to departure for any reason and receive up to 100% for future travel.

Cancellation/Switching Trips

If a Traveller must cancel their Trip the fees are as follows:

61-90 25% of Trip price
31-60 50% of Trip price
0-30 100% Trip price

More than 60 days prior to the original departure date, you may transfer to a different Trip in the same calendar year, provided a Trip and/or space is available, upon payment of a fee of US$300 per person. If you cancel this subsequent reservation then the cancellation fees applicable shall be the higher of the cancellation fee on your original reservation or the cancellation fee on the Trip to which you transferred. Within 60 days of departure the regular cancellation fees will apply.

Travel Documents and Passports

Each country visited by Paul Hyde Journeys has unique visa and passport requirements depending on your nationality and country of residence. These requirements may change without warning for reasons beyond our control. While Paul Hyde Journeys will always try to provide you accurate and timely information about these requirements we must ultimately rely on each Traveller to confirm that they have the correct travel documents for their particular destination, nationality and country of residence and that of their family. Paul Hyde Journeys cannot be held liable for any expenses or costs arising from Traveller being denied access or prohibited from entering a country visited on a Trip.

Paul Hyde Journeys further recommended that Travellers retain separate photocopies of all travel documents in a safe and separate place in the event of loss of principle travel documents.

Eligibility

Paul Hyde Journeys require that travelers be at least 18 years of age on all trips except for Family Trips which are variously designated for children 8 years of age or older.

General

Meaning of Paul Hyde Journeys

The Traveler acknowledges that for all purposes the expression "Paul Hyde Journeys" means Paul Hyde Journeys Inc., an Ontario corporation and includes all affiliates thereof and their respective employees, coaches, instructors, guides, shareholders, officers and directors.

Application

This Acknowledgement of Risk, Limitation of Liability, Release and Indemnity, applies to the Travellers Trip with Paul Hyde Journeys and any transfer of a reservation to another Trip.

Binding Effect

The Traveller Acknowledges that the Risk, Limitation of Liability, Release and Indemnity is binding upon the Traveller and all members of their family, dependents, their respective estates, heirs, successors and legal representatives.

Governing Law

The Traveller agrees that any claim or dispute arising out of or relating to this Acknowledgement of Risk, Limitation of Liability, Release and Indemnity, or its interpretation, the Trip, or my relationship with Paul Hyde Journeys will be resolved exclusively in the courts of the Province of Ontario and will be governed exclusively by Ontario law.


I have carefully read the above Acknowledgement of Risk, Limitation of Liability, Release and Indemnity. I understand this document governs my rights and limits my potential remedies and I nevertheless accept it voluntarily and knowingly.
